Couple handed a suspended jail sentence and 150 hours of community service
A Lancashire husband and wife team have been sentenced in Preston Crown Court for operating an illegal “above-ground landfill site” at their Poulton-le-Fylde based skip hire business.
John and Elaine Park, aged 53 and 44 respectively, owned a skip hire business in Bracewell Avenue, Poulton-le-Fylde. Mr Park was in possession of a valid environmental permit for the site, however, Mrs Park managed the skip hire business and things had been allowed to get out of the couple’s control.
The couple would accept waste at their Greenacres Recycling Centre, based also in Bracewell Avenue, where it was supposed to be sorted and treated. They accepted waste that was considered toxic and required strict regulation under environment law.
The Environment Agency (EA) became aware of the conditions at Greenacres Recycling Centre and informed the couple that they must fix the problem. The EA told Preston Crown Court that the couple had no viable waste management plan and had allowed waste to build up on the land surrounding the recycling centre.
Kevin Slack, prosecuting for the EA, said that the recycling building “benefitted from an impermeable surface and a sealed drainage system”, however waste had built up to significant levels outside, where there was “no sealed drainage system”, thus posing a serious health hazard.
Mr Park, of Fleetwood Road, in Poulton-le-Fylde, was given an 18-months suspended jail term, while Mrs Park, of the same address, was ordered to carry out 150 hours of unpaid community work.
